1. CONCEPT AND TYPES OF COOKIE

 

1.1. CONCEPT

What cookies are? A cookie is a file that is downloaded to your computer when you access to certain web pages. Cookies allow a website, among other things, store and retrieve information about browsing habits of a user or your computer, depending on the information they contain and the way you use your computer, can be used to recognize the user.

1.2. TYPES OF COOKIES

(i) Depending on who is the entity that manages the computer or domain from which cookies are sent and treat the data obtained, we can distinguish:

- own cookies: those that are sent to the terminal user's computer from a computer or domain managed by the editor itself and from which the service requested by the user is provided.

-Third Party Cookies: those that are sent to the terminal user's computer from a computer or domain that is not managed by the editor, but by another entity which proceeses the data obtained through cookies.

(ii) Depending on the length of time they remain active:

- Session Cookies: Cookies designed to collect and store data while the user accesses a web page. They are often used to store information only interested in preserving for the service requested by the user on a single occasion.

- Persistent Cookies: A type of cookies in which the data remains stored in the user's terminal and can be accessed and treated for a time set by the cookie's responsible, and it could last from a few minutes to several years.

(iii) Depending on its purpose:

- Technical Cookies: These are those that allow the user to navigate through a website, platform or application and use its different options or services, for example, control traffic and data communication, identify the session, access parts of restricted access, remember the elements of an order, make the buying process, make the request for registration or participation in an event, use security features while browsing store content for broadcasting videos or sound or share content via social networks.

- Customization cookies: those that allow the user to access the service with some features of a general nature predefined depending on a number of criteria in the user terminal such as would be the language, type of browser through which you access the service , the local settings from where which you access the service, etc.

- Analysis cookies: those that allow the responsible therefor, monitoring and analyzing the behavior of users of the websites to which they are linked. The information gathered through such cookies is used in measuring the activity of web, application or platform sites and profiling of users navigation of such sites, applications and platforms, in order to make improvements in based on analysis of usage data from the users of the service.

- Advertising Cookies: These are those that enable the management in the most efficient way of advertising spaces, where appropriate, the editor has included on a website, application or platform from providing the requested service based on criteria as the edited content or the frequency in which ads are displayed.

- Behavioral advertising cookies: they are those that allow management in the most efficient way of advertising spaces, where appropriate, the editor has included on a website, application or platform from providing the requested service. These cookies store information on user behavior obtained through continued observing their browsing habits, allowing to develop a specific profile to display ads based on the same

3. CONSENT TO THE USE OF COOKIES

 

Act 34/02 provision 22.2, first and second paragraphs states:

2. Service providers can use storage devices and data retrieval terminal equipment recipients, provided that they have given their consent after they have provided them with clear and comprehensive information on their use, in particular, about the purposes of processing the data in accordance with the provisions of Law 15/1999 of 13 December on protection of personal data.

Where technically possible and effective, the consent of the recipient to accept the processing of data may be provided by using the appropriate settings of a browser or other applications.

According to the above, the users may consent to the use of cookies:

a) expressly accepting the OK button on the first layer cookies information that appears on every page of this site until expressly accepted.

4. NOT NEED OF CONSENT FOR ACCEPTANCE OF COOKIES UNDER CERTAIN CONDITIONS

 

Provision 22.2 third and last paragraph of Act 34/02 provides for two exceptions to obtain the users' consent on cookies implementation by providing:

This does not prevent any storage or tehnical access for the sole purpose of carrying out the transmission of a communication by an electronic communications network or to the extent strictly necessary for the provision of a service of the Information Society expressly requested by the recipient.

Thus, the user's express application for the provision of submitting and paying the form 210 before the Spanish Tax Authorities means that the client consent specifically to the implementation of the necessary cookies for the provision of that service.

 

5. CONSEQUENCES OF NOT GIVING CONSENT TO THE COOKIES

 

Non-acceptance of cookies does not essentially affect navigation and usability of this web.

Besides the users have to keep in mind that the web may, without consent, implement the essential technical cookies to use the web (access cookies for instance).
